What the law requires on your website
A lawful ground
Processing needs justification; for cookies that profile or feed advertising, consent is the practical ground.
Openness
Data subjects must be notified about collection: what, why, and who. A consent dialog provides that transparency layer.
Direct-marketing consent
Electronic direct marketing requires opt-in consent unless you are marketing your own similar products to existing customers, and since April 2025 the regulations expect that consent in written form. Marketing trackers are a clear consent case.
How Clickio Consent helps

Customization →Evidence on file

Reporting →Frequently asked questions
Does POPIA require cookie consent?
POPIA doesn't name cookies, but tracking that processes personal information needs a lawful ground, and its direct-marketing rules require opt-in consent, so a consent dialog is the practical answer for marketing and profiling trackers.
Who enforces POPIA?
South Africa's Information Regulator, which can issue enforcement notices and fines up to ZAR 10 million; some offences carry criminal liability.
Does POPIA apply to foreign companies?
POPIA covers a responsible party that is not based in South Africa when it uses equipment or other means inside the country to process personal information, other than just routing data through. Serving a South African audience with tracking on local devices is commonly read to fit that test, so foreign websites with South African traffic should treat it as in scope.
Is POPIA consent like GDPR consent?
The definitions rhyme: voluntary, specific, informed. A GDPR-grade consent dialog is built to the same standard POPIA describes.
How does Clickio handle South African traffic?
Geo-detection identifies visitors from South Africa and serves the consent experience you configure for them, without affecting your GDPR, US or other regional flows.
